This plaintiff's affidavit for service by publication or posting may be used in Illinois when by plaintiff in an eviction action must serve the defendant by publication or posting. This template may be used in a residential or commercial eviction case. See 735 ILCS 5/9-107. In Illinois, a plaintiff may only serve the defendants(s) in an eviction action by publication or posting if the following criteria are met: 1. At least one prior summons was issued and returned without service being made -- and -- 2. One of the following is true: a. The defendant or unknown occupant is not a resident of Illinois. b. The defendant or unknown occupant has departed from Illinois. c. The defendant or unknown occupant is concealed within Illinois. – or-- d.
